1) PREMISE

RETTIFICHE PISTOIESI srl sells and delivers new or overhauled mechanical parts throughout Italy and abroad.

The commercial relations between RETTIFICHE PISTOIESI srl and the customer are governed by the following general conditions of sale.

Placing an order online implies full acceptance of these conditions.

2) ORDER CONFIRMATION

Each order received will be confirmed to the customer by email

3) PROCESSING AND DELIVERY TIMES

The order will be processed after payment has been confirmed. Times will vary depending on the mode chosen. For orders that arrive with confirmation of payment by 11.30 a.m., they will be processed immediately.

Delivery is expected within 48 hours of the order on the Italian territory. For foreign countries, delivery is subject to the timing implemented by the courier. In any case, we will not be liable for any delay or failure to comply with the obligations set out in these general conditions, if the delay or non-performance results from unforeseeable circumstances or force majeure. This provision does not affect your statutory rights.

Delivery times refer to the products available in stock.

For other products, the delivery date will be communicated by e-mail and/or telephone

4) SHIPPING COSTS

Deliveries made in the municipality of Pistoia and in the neighboring municipalities will be made by our vehicles at no additional cost.

For other destinations, shipping will be by courier and the following charges will be applied:

other € 30.00 +VAT

Free transport if the goods are picked up at the point of sale

5)PRICE

The price of the product does not include VAT, shipping and any deposit

6)CONDITIONS OF THE DEPOSIT

Prices are based on the supply of the remanufactured product with the return to RETTIFICHE PISTOIESI srl of the end-of-life product of the same type and version to be carried out within 30 days of supply, under penalty of mandatory debit on the invoice of the sum equal to the value of the non-return.

Features of the End-of-Life Product

The end-of-life product must not have visible damage from the outside (e.g. holes in the engine block or gearbox bell, etc.), otherwise the product deposit will be charged. In addition, the end-of-life housing must be mounted, washed externally and free of oil. Gearboxes that are out of use must be free of cracks or breaks at the level of the supports and bells.

7) PAYMENTS

By

- Cash or non-transferable bank chequemade out to Rettifiche Pistoiesi S.r.l to be delivered directly to the courier;

- By credit cards directly from the site

- Bank transfer in advance when goods are ready

By bank transfer, specifying the order number issued by the system in the reason for payment.

Only payments from current accounts in the name of the order holder will be accepted.

By accepting the conditions of sale and clicking on the Buy button, the buyer STRICTLY undertakes to make the payment by bank transfer no later than 3 days, under penalty of cancellation of the order.

Further forms of payment will be agreed in advance with prior authorization.

8) WITHDRAWAL

WITHDRAWAL OF THE CUSTOMER

Sales of products via the Internet are governed by Legislative Decree no. 185 of 22/05/1999 which regulates the matter of distance contracts, i.e. carried out outside commercial premises. This legislation establishes the right of withdrawal, i.e. the possibility for the consumer to return the purchased product and obtain a refund of the expense incurred.

The Customer has the right to withdraw, without any penalty and without having to specify the reason, no later than 10 working days from delivery (the delivery date shown on the courier's waybill is valid).

The right of withdrawal is exercised within the deadline by sending a registered letter with acknowledgement of receipt and all the goods purchased from RETTIFICHE PISTOIESI srl

The communication can also be anticipated by fax, provided that it is confirmed by registered letter with acknowledgement of receipt within the following 48 hours.

In the event of applicability of the right of withdrawal, the Customer is required to return at his own expense all the items relating to the invoice as they have been received, i.e. absolutely new, unused, complete with all their parts and in the original packaging (pallets, trestles or boxes).

Failure to comply with these principles renders the right of withdrawal inapplicable. In the event of application of the right of withdrawal, once the goods have been received, RETTIFICHE PISTOIESI srl will refund the entire

amount paid by the customer, excluding shipping costs, within thirty days from the date on which the communication was received by bank transfer.

WITHDRAWAL OF THE SUPPLIER

RETTIFICHE PISTOIESI srl, should it be unable to process the order requested from

due to the unavailability, even temporary, of the ordered product, has the right to withdraw from the sales agreement within 30 days from the date of the order by providing the customer with a simple reasoned communication, pursuant to art. 6, paragraph 2 of Legislative Decree 185/99. In this case, the customer will only be entitled to a refund of any amount already paid.

9) RETURNS AND EXCHANGES

The Customer must check the integrity and number of packages upon arrival of the goods. In the event of an anomaly, you must sign the transport document "subject to inspection" highlighting the reason (e.g.: heavily damaged package or missing package) and send an e-mail to our customer service within 24 hours of receipt of the goods. In the event of replacement for goods that do not comply with the order, the communication must always be sent to the address info@rettifichepistoiesi.com within 5 days from the date of delivery, it will be RETTIFICHE PISTOIESI SRL to communicate the procedure to be carried out

10) WARRANTY

The purchase of material from RETTIFICHE PISTOIESI srl, implies the full acceptance of the warranty conditions provided, which may be independent of the validity of the same.

Our products are guaranteed for 12 months from the date of sale. The warranty is only valid under the following conditions:

- The buyer must contact RETTIFICHE PISTOIESI srl and receive authorization, before deciding on any repair

-Checks must be carried out by qualified personnel

- Assembly rules, draughts, phases and running-in must be carried out scrupulously

- In case of replacement, the defective parts must be sent back to RETTIFICHE PISTOIESI srl with a technical report of the incident

- The warranty consists of the free replacement of defective products or products that can no longer be used due to ascertained defects in material or workmanship

-Costs for detachment and reattachment will be reimbursed, after we have ascertained our actual liability, according to the original timetable or Autodata

THE WARRANTY DOES NOT INCLUDE

- machine downtime

- Small parts, oil, antifreeze, filters, various liquids;

- Towing, travel and transport expenses;

- Any purchase costs for material not authorized by us.

The warranty will not be recognized if the damage results from incorrect installation, negligence, misuse of the engine, tampering with the original parameters, or causes not dependent on imperfections in material or workmanship

11) LEGAL NOTICES

The images that accompany the various articles are purely indicative and do not always represent the article in detail. To be sure not to make mistakes, you should not rely on images but pay close attention to the descriptions that accompany each item. In case of uncertainty, our technical or commercial support is at your disposal to get all the clarifications you need. Le RETTIFICHE PISTOIESI srl complies with the regulatory and legislative provisions in force regarding social responsibility. For users of the site who are minors or belonging to the weakest categories, subjects who have parental authority or legal responsibility for them may exercise the right of withdrawal according to the provisions in force.

12) PRIVACY

Pursuant to Article 13 of Legislative Decree 196/2003, le RETTIFICHE PISTOIESI srl will process the data you provide in compliance with the legislation on the protection of the processing of personal data.

The provision of data is optional, but any refusal to provide them will make it impossible to execute the obligations arising from the contract to which you are a party.

The personal data you provide are collected electronically and processed, also with the aid of electronic means, directly and/or through delegated third parties for the following purposes:

- purposes related to the execution of the service and the management of the purchase order of the products;

- statistical purposes, sending advertising material, also through the use of e-mail.

As part of administrative-accounting, tax, logistical and marketing activities, it is sometimes necessary to communicate some of the data processed (e.g.: banks, accountants, external consultants, public offices, home delivery companies, companies that provide their work in outsourcing).

A list of names of these subjects can be found at our headquarters. RETTIFICHE PISTOIESI srl undertakes not to communicate or disseminate any information concerning it for commercial purposes and not to sell, share or transfer its databases. Within the company, the data can only be known by specifically appointed subjects.

Pursuant to Article 7 of Legislative Decree 196/2003, you have the right at any time to obtain information from the Data Processor on the processing of your data, its methods and purposes and the logic applied to it, as well as:

1) confirmation of the existence of the data and the communication of the same and their origin;

2) the identification details of the Data Controller and Data Processors as well as the subjects or categories of subjects to whom the data may be communicated or who may become aware of them in their capacity as Data Processors or persons in charge of

the data;

3) the updating, correction and integration of data;

4) the cancellation, transformation into anonymous form, blocking of data processed in violation of the law;

5) certification that the operations referred to in points 3) and 4) have been brought to the attention of those to whom the data have been communicated and disseminated, with the exception of the case in which this fulfilment proves impossible or involves the use of means manifestly disproportionate to the protected right;
